A new physiotherapist arrives to register. They ask about the requirements. The receptionist says: "You need liability insurance." The response: "But why? Nothing's going to happen to me." We hear the same thing every month. The truth is: liability insurance isn't a question of "if." It's a question of "when." In this article we explain why liability insurance is mandatory, how much it costs, and what your options are.

Is liability insurance mandatory for a physiotherapist?

The short answer: Yes -- if you run a professional practice or a healthcare entity. If you work solely as an employee, you're covered by your employer's insurance.

The long answer requires some law.

The obligation to have liability insurance derives from:

  • The Minister of Finance's Regulation of 29 April 2019 (Journal of Laws 2019, item 866) -- governs mandatory liability insurance for entities performing medical activity
  • Article 415 of the Civil Code -- liability for damage caused
  • RPWDL requirements -- the national register requires liability insurance as a condition of registration (for healthcare entities)

Mandatory liability insurance applies to professional practices and healthcare entities. A physiotherapist employed under an employment contract doesn't need their own mandatory policy -- they're covered by their employer's insurance.

No insurance = removal from the RPWDL = end of your career. That's how important it is.

When did liability insurance become mandatory?

The obligation stems from the Minister of Finance's Regulation of 29 April 2019. Individual and group physiotherapy practices have been able to operate since 1 April 2019 and have been subject to the insurance obligation from the start. Today (2026), every practice and every healthcare entity must have liability insurance.

Minimum guarantee sums -- how much should your policy cover?

The law specifies minimum sums, below which insurance doesn't meet the requirements.

Guarantee sums under the Ministry of Finance Regulation

  • Minimum sum per single event: 30,000 EUR
  • Minimum aggregate sum (annual): 150,000 EUR

What does this mean in practice?

  • If a patient sues you for 20,000 PLN (damage caused), the policy should cover up to 30,000 EUR (approx. 130,000 PLN)
  • If there are several claims in a year (totalling as much as 100,000 PLN), the policy should cover everything up to 150,000 EUR (approx. 650,000 PLN)

In practice: most policies go higher. Popular options:

  • 50,000 EUR / 250,000 EUR -- safe for a small practice
  • 100,000 EUR / 500,000 EUR -- for group practices

How to get insured? Options available to physiotherapists

You have several options. Each has pros and cons.

Option 1: KIF (the National Chamber of Physiotherapists)

How it works: KIF provides mandatory liability insurance to physiotherapists running a practice as part of the membership fee.

Cost: No extra charge -- since 2024/25, the insurance is provided as part of the KIF membership fee (45 PLN/month)

Pros:

  • The cheapest
  • Everything's already arranged (automatically)
  • No need to shop around

Cons:

  • Guarantee sum: exactly the minimum (30,000 EUR / 150,000 EUR)
  • Limited scope for customisation
  • If KIF changes insurer, you have no say

Is it worth it: If you work alone as a professional practitioner -- yes. It's the cheapest and sufficient.

Option 2: Independent insurance -- policies available on the market

You can buy a liability policy independently of KIF.

Main insurance companies offering liability cover for physiotherapists (indicative rates -- check current pricing before buying):

  • INTER Polska -- an individual policy, from around 200 PLN a year
  • Compensa -- a policy for medical teams, from around 250 PLN/person
  • WARTA -- insurance for medical practices, from around 180 PLN a year
  • Stowarzyszenie Fizjoterapia Polska (the Polish Physiotherapy Association) -- group insurance for members, from around 120 PLN a year

Pros:

  • Ability to choose higher guarantee sums
  • Greater flexibility
  • Sometimes offers additional coverage (mediation, legal assistance)

Cons:

  • More expensive than KIF
  • You have to shop around and compare yourself
  • Sometimes requires a medical certificate

How it works: You contact the insurance company, fill in a form, pay the premium, receive the policy. The policy takes effect the next day.

Option 3: Insurance as part of employment/contract work

If you work at a practice/clinic as an employee, your employer is obliged to provide liability insurance. The policy covers you while you're working on that facility's premises.

Important: This policy covers you ONLY within the scope of your contract with that specific employer. If you simultaneously work on your own account, you need a separate policy.

Cost of liability insurance -- what will you actually spend?

We've gathered market data for 2026.

Annual premium by business form

Professional practice (alone, no employees):

  • KIF: no extra charge -- insurance included in the membership fee (45 PLN/month)
  • Individual policy (e.g. with higher guarantee sums): 180-300 PLN a year (indicative)

Healthcare entity (1-2 employees):

  • Entity policy: 400-600 PLN a year
  • INTER Polska: 500-700 PLN
  • Stowarzyszenie Fizjoterapia Polska: 250-350 PLN per person (less in total)
  • Average: ~450-600 PLN a year

Large practice (3+ employees):

  • Corporate policy: 800-1,200 PLN a year
  • Sometimes a discount for number of employees
  • Average: ~1,000-1,500 PLN a year

What does liability insurance cover? -- And what does it NOT cover?

This is an important question. Many people think insurance covers "everything." It doesn't.

What DOES liability insurance cover?

  • Diagnostic errors -- e.g. you misdiagnose an injury and the patient suffers as a result
  • Treatment errors -- e.g. an incorrect physiotherapy grip causes deterioration (e.g. a muscle tear)
  • Injuries during a treatment -- e.g. a patient falls, hits their head on a cabinet
  • Reactions to therapeutic techniques -- e.g. a patient has an allergy to a substance used during massage
  • Infections due to poor hygiene conditions -- e.g. a patient gets an infection because of an undisinfected treatment table
  • The patient's financial losses -- e.g. a patient lost the ability to work for 3 months because of your mistake -- insurance reimburses the loss of income

What DOESN'T liability insurance cover?

  • Intentional acts -- if you deliberately harm a patient (that's criminal law, not insurance)
  • Activity outside your practice -- e.g. a car accident unrelated to your work
  • Non-compliance with regulations -- e.g. you work without a licence or without liability insurance, the insurer may refuse to pay out
  • Past events -- the policy covers events from its effective date onward
  • Accidents involving third parties -- e.g. a patient bumps into another person on your premises -- that's the premises' liability (property insurance), not yours

Consequences of not having liability insurance -- removal from the RPWDL

What happens if you don't have liability insurance?

Consequence 1: Removal from the RPWDL

The national register of healthcare entities (RPWDL) requires liability insurance as a condition of registration. No insurance = removal.

This really happens. Compliance with the insurance obligation is checked by the registering authority -- for physiotherapy practices, this is the National Council of Physiotherapists. If you don't have insurance:

  1. You receive a notice: "Within 14 days, provide proof of liability insurance"
  2. If you fail to respond -- you're struck off the RPWDL
  3. That's it. You can no longer work legally

Restart: You must re-register with proof of insurance. This costs time and effort.

Consequence 2: Personal financial liability

If a patient sues you and you don't have liability insurance, you're liable out of your own pocket. In the worst case, your wages, house, or flat could be seized. This isn't an exaggeration -- it's how Polish civil law works.

Real-world example:

  • Patient: "You did a bad manipulation. Now I have headaches, I can't work"
  • Compensation: 15,000 PLN
  • You without insurance: you must pay out of your own pocket
  • You with insurance: the insurer pays

Consequence 3: Problems with credit and loans

Banks may ask about liability insurance. No insurance = higher risk assessment = worse for you.

How to choose the right policy? A practical guide

You need to choose insurance. Where to start?

Step 1: Determine your business form

  • Working alone? → KIF or an individual policy
  • Have 1-2 employees? → A policy for a small healthcare entity
  • Have 3+ employees? → A corporate policy

Step 2: Determine the guarantee sum you need

  • Legal minimum: 30,000 EUR / 150,000 EUR
  • For safety: 50,000 EUR / 250,000 EUR
  • For large practices: 100,000 EUR / 500,000 EUR

In practice: choose at least 50,000 EUR per event. It's not much more expensive, and it's safer.

Step 3: Compare 3 offers

  • KIF (if you're a member): simplest, cheapest
  • INTER Polska: reputable, many offers
  • Stowarzyszenie Fizjoterapia Polska: sometimes the lowest price for groups

Call, ask for a quote. It takes 10 minutes.

Step 4: Check the insurance terms

  • Does the policy also cover running group classes?
  • Are there exclusions (e.g. doesn't cover diagnostic errors)?
  • Can you change insurer during the year without penalty?

Step 5: Buy and register

Apply online, pay, receive the policy by email. Done.

Piotr opens a professional practice. He does some quick research. He discovers that KIF provides mandatory liability insurance as part of the membership fee (45 PLN/month, i.e. 540 PLN a year) -- at no extra charge. The membership includes:

Piotr thinks: "Mandatory insurance at no extra charge? One obligation off my plate." He's right. For him, the KIF solution is ideal.

Anna and Tomek set up Centrum Fizjoterapii (Ltd). They have 3 employees. Anna calls INTER Polska:

Frequently asked questions

Does my liability insurance cover me when I work for someone else?

It depends. If you work as an employee for an employer, your employer has liability insurance covering all employees. You don't need your own liability insurance to work for them.

BUT: If you simultaneously work on your own account (running your own practice), you need liability insurance for your own practice.

Practical rule: If you work 100% for one employer, you can get by without your own insurance. If you work on your own account (even 10 hours a week), you need liability insurance.

Does liability insurance cover me if I work online (virtual consultations)?

Yes -- unless the policy excludes it. Most policies also cover online advice. But check the terms. Tell your insurer that you plan to work online.

What happens if a patient sues me after my liability policy has expired?

This depends on the date of the event, not the date of court proceedings.

  • Event: 1 January 2026 (policy active)
  • Lawsuit: 1 July 2027 (policy expired)
  • Outcome: The 2026 policy covers it -- because the event took place while the policy was active

That's why it's important never to have a gap in coverage. Even one day without liability insurance is a risk.

Can I change insurer mid-year?

Yes -- but sometimes this comes with a penalty for terminating the contract. Check the policy terms. Usually you can change without penalty after 12 months.

Tip: If you find a better offer, wait until your policy's anniversary. Then changing is free.
